- User Management: Administrators are authorized to assign roles and permissions to domain members. You are responsible for configuring security settings, user roles, and managing access levels.
- Compliance with Laws: Administrators must ensure the domain complies with all applicable laws, including data protection regulations like GDPR.
- Data Privacy & Collection: Administrators can access member data (access logs, attendance) but must ensure it is used solely for operational purposes. Data cannot be misused or shared with third parties unless required by law.
2.2 Intellectual Property and Software Use:
- License Rights: Administrators may configure domain settings but may not reproduce or resell the BroadAccess software.
2.3 Limitation of Liability:
- BroadAccess shall not be liable for any data breaches or losses caused by administrative negligence in managing domain data or security settings.
2.4 Acceptable Use Policy for Domain Management:
- Administrators must implement secure, privacy-compliant practices in managing domain data and ensure that domain activities comply with BroadAccess’s acceptable use policies.
2.5 Dispute Resolution:
- Administrators agree to resolve disputes through mediation and abide by UK jurisdiction should formal proceedings be necessary.
3. BroadAccess Domain Members
Scope: This section pertains to users who are regular members of BroadAccess-managed domains, such as workplaces or educational institutions.
3.1 User Rights and Responsibilities:
- Access Permissions: Members are granted access to the domain based on their role, and these permissions are managed by the domain administrators. Members must report any unauthorized use or breaches.
- Content Use: Members agree not to upload content that violates copyrights or disrupts the domain environment.
3.2 Data Privacy:
- Data Collection: Personal data, including login times, access logs, and communication, is collected for operational purposes. This data will be securely stored and handled under GDPR.
- Data Rights: Members can request access to, or deletion of, their personal data from the domain administrator, except in cases where such actions violate legal obligations.
3.3 Acceptable Use:
- Members must not misuse the domain's resources (e.g., sharing login credentials, installing unapproved software).
3.4 Intellectual Property Rights:
- All content within the domain remains the property of BroadAccess or the respective owners. Members are not allowed to reproduce, distribute, or use this content outside the domain without permission.
3.5 Limitation of Liability:
- BroadAccess will not be liable for any personal data breaches caused by members sharing their credentials or through negligent behaviour.
4. BroadAccess Domain Guests
Scope: Guests invited to use specific domain facilities temporarily.
4.1 Guest Rights and Responsibilities:
- Temporary Access: Guests receive limited access to the domain for a specified period. Guests must adhere to the security and conduct guidelines set by domain administrators.
4.2 Privacy & Data Handling:
- Data Collection: Limited personal data such as name, contact details, and access logs will be recorded during the guest’s visit. This information is only retained for the duration of the visit unless required for legal reasons.
4.3 Acceptable Use:
- Guests must use the domain responsibly and comply with all security protocols, including refraining from accessing restricted areas or engaging in any unlawful activities.
4.4 Liability & Indemnity:
- BroadAccess will not be liable for any damages or losses incurred by guests during their visit.
5. BroadAccess Domain Creation & Management
Scope: Users who create and manage domains on the BroadAccess platform.
5.1 Rights and Responsibilities:
- Domain Creation: Users creating domains must ensure that their domain complies with applicable laws, regulations, and BroadAccess’s terms. This includes ensuring GDPR compliance and monitoring for security risks.
5.2 Privacy & Data Handling:
- User Data Collection: Domain creators have access to data related to domain operations, which must be handled in a secure, lawful manner. Unauthorized sharing of personal data is prohibited.
5.3 Intellectual Property Rights:
- Software Licensing: Domain creators are granted a non-exclusive license to use BroadAccess’s software for managing domains but are prohibited from reselling or redistributing it.
5.4 Liability and Indemnity:
- BroadAccess is not liable for any third-party claims arising from the misuse of a domain. Domain creators must indemnify BroadAccess for any losses resulting from their violation of these terms.
5.5 Acceptable Use:
- Domains must not be used for illegal or unethical purposes, including fraud, harassment, or other activities that violate local and international laws.
